Why you and your EHR vendor should care about the Cures Act

The 21st Century Cures Act, which went into effect April 5, 2021, is something not only you, as a provider, need to be concerned about, but your EHR vendor must comply with as well.

So, what is Cures? It’s legislation, designed to eliminate the practice of preventing patients from accessing their health information electronically AND inhibiting the flow of this information electronically to where they want it to go (e.g., between providers). This practice is known as information blocking.  Information blocking can take many forms.  If you’ve tried to send a patient’s medical record electronically from your EHR to another provider’s EHR without much success, you’ve just experienced information blocking. If you’ve tried to leave your EHR vendor only to discover either you can’t get your patient data in an electronic format or, it will cost you thousands of dollars, you and your patients have been victims of information blocking.

While there are some steps you SHOULD take to be compliant with Cures, there’s many more your EHR vendor MUST take. Cures requires that all ONC 2015 certified EHR vendors update their certification to comply with Cures by December 31, 2022. Vendors who fail to update risk losing their certification for MACRA/MIPS and being fined up to $1M for information blocking.  That’s why it’s important you check with your EHR vendor NOW to confirm they can meet this deadline.
